1. Scope
These General Terms and Conditions (GTC) apply to all business relationships between airtime AG, Bern, Switzerland (hereinafter "airtime") and its customers (hereinafter "Customer"). By ordering or purchasing a product or service from airtime, the Customer accepts these GTC.
2. Offer and Contract
All offers from airtime are non-binding unless expressly stated otherwise. A contract is only concluded upon written order confirmation by airtime.
3. Prices and Payment
All prices are in Swiss Francs (CHF), excluding value-added tax (VAT), unless otherwise stated. Payment is due within 30 days of invoicing. In case of late payment, airtime is entitled to charge default interest of 5% per annum.
4. Delivery
Delivery dates are non-binding unless expressly agreed as binding. airtime endeavors to meet the stated delivery deadlines. Delays do not entitle the Customer to compensation.
5. Warranty
Unless otherwise agreed, airtime provides a bring-in warranty of 24 months from the delivery date for its products. The warranty covers material and manufacturing defects. Damage caused by improper use, external influences, or normal wear and tear is excluded. Warranty claims must be submitted to airtime in writing.
6. Liability
The liability of airtime is limited to the purchase price of the respective product. airtime is not liable for indirect damages, consequential damages, or lost profits. Liability for slight negligence is excluded to the extent permitted by law.
7. Intellectual Property
All rights to trademarks, designs, software, and other intellectual property rights of airtime remain with airtime. The Customer is not granted any right to use airtime's intellectual property, except in the context of the intended use of the purchased products.
8. Data Protection
airtime treats personal data confidentially and in accordance with the Swiss Data Protection Act (DPA). Data is only used for contract processing and to improve services. Further information can be found in our privacy policy.
9. Applicable Law and Jurisdiction
Swiss law applies exclusively. The place of jurisdiction for all disputes arising from or in connection with these GTC is Bern, Switzerland.
